Brian Leubitz discusses the recent decision here. Although the decision is narrow in applicability, he points out,

Judge Walker's findings of fact...were not disputed. The standard for changing these findings of fact is substantially higher than for the legal conclusions, but the maintenance of those facts is nonetheless important and notable.

He quotes from the statement:

The designation is important because 'marriage' is the name that society gives to the relationship that matters most between two adults. A rose by any other name may smell as sweet, but to the couple designing to enter into a committed lifelong relationship, a marriage by the name of 'registered domestic partnership' does not.

Furthermore, Leubitz writes, when Reinhardt gets to his conclusion, it is stark and simple:

Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples.

Exactly. The thing that gives me hope is that the polls show that the population of California is gradually awakening to this idea. In spite of the dollars being poured into the Prop 8 rhetoric.

I too love how clear and emphatic the statement is.

This new ruling is just wonderful. It gives me faith that the sane people are still out there.

A few of us, yes. The battle isn't won, but at least these judges acted with integrity.

Nice. I hadn't read the decision.

As for why DPs (and local laws) aren't enough, I am a font of Very Good Reasons. They start with immigration. Last I checked legally-married same sex spouses were still getting deported by the Federal government.
